RESUMEN

La asistencia jurídica a las víctimas d e violencia de género

representa uno de los retos en el ejercicio profesional d e la

abogacía en Cuba, a partir de la reforma procesal penal,

como consagración de las garantías constitucionales

establecidas el 2019. El acompañamiento a la víctima que

ha sufrido violencia de género requiere una mirada en el

orden normativo y técnico-profesional, y desde las

instituciones jurídicas encargadas de su asesoramiento y

representación. El presente trabajo pretende evaluar a

partir de estas tres dimensiones la asistencia jurídica a la

víctima de violencia de género a fin de identificar las

limitantes que pueden obstaculizar la concreción de esta

garantía constitucional, así como formular pauta s de

actuación para el abogado en el proceso penal en la

representación a la víctima de violencia de género.

ABSTRACT

Legal assistance t o victims of gender-based violence

represents one of the challenges in the professional practice

of law in Cuba, based on the criminal procedure reform, as

a consecration of the constitutional guara ntees established

in 2019. The accompaniment to the victim that has suffered

gender violence requires a look at the normative and

technical-professional order, and from the legal

institutions in charge of their advice and representation.

The present work intends to evaluate from these three

dimensions the legal assistance to the victim of gender

violence in order to identify the limitations that can hinder

the realization of this constitutional guarantee, as well as

formulate action guid elines for the lawyer in the criminal

process. in the representation of the victim of gender

violence.
