The Family Caregiver. A Pending Issue for Labor Law and Social Security

RESUMEN

En Cuba la existencia del cuidador familiar ha logrado un

fuerte auge pues debido a la longevidad de la población son

varios los familiares que han asumido esta noble tarea que

resulta la protección de otro familiar. La ac tual

Constitución del 2019 se pron uncia sobre la debida

protección y cuidado que deben brindar los familiares a sus

adultos mayores, así como también el deber del Estado de

garantizarles los medios y vías para que los mismos vivan

dignamente. De igual forma el Proyecto del Código de las

Familias reconoce la debida salvaguarda de los derechos de

las abuelas y abuelos y la obligación de los h ijos para con

sus padres como la institución del cuidador familiar en sus

artículos del 40 9 al 416. Sin embargo, tanto la

Constitución como las nuevas normativas resultado de esta

imponen retos para diferentes discip linas del sector

jurídico. De esta regla no escapa el Derecho del Trabajo y

la Seguridad Social, el cual debe asumir un trato

diferenciado, especializado para con aquellos trabajadores

que se encuentren en esta situación de cuidadores

familiares.

ABSTRACT

In Cuba the existe nce of the family caregiver has achieved

a strong boom because due to the longevity of the

population there are several family members who have

assumed this noble task that results in the protection of

another family member. The current Constitution of 2019

pronounces on the due protection and care that family

members must provide to their older adults, as well as the

duty of the State to guarantee them the means and ways for

them to live with dignity. Similarly, the Family Code

Project recognizes t he due safeguarding of the rights of

grandmothers and grandfathers and th e obligation of

children to their parents as the institution of the family

caregiver in its articles 409 to 416. However, both the

Constitution as well as the new regulations resulting from

it impose challenges for different disciplines of the legal

sector. The Labor and Social Security Law does not escape

this rule, which must assume a differentiated, specialized

treatment for those workers who find themselves in this

situation of family caregivers.
