RESUMEN

Estamos en la era digital y los usuarios han

encontrado el modo de estar conectados y

actualizados de las noticias que le interesan o

simplemente a través de las redes sociales y otros

medios tradicionales participan del entretenimiento

que ofrecen; logrando también conocer de hechos

estentóreos y presumiblemente delictivos que en no

pocas ocasiones son presentados sin evidencias y

carente de valoraciones jurídicas. En este trabajo se

pretende analizar la problemática que se plantea

para la justicia penal cuando medios masivos de

comunicación vulneran principios como la

presunción de inocencia y se superan los límites de

la libertad de prensa, concluyendo nuestras

observaciones con algunas propuestas para lograr

la ponderación y la armonía que es necesaria

observar ante esta extendida problemática social en

evitación a las afectaciones que se producen a la

identidad y personalidad de los sujetos

involucrados en hechos penales.

ABSTRACT

We are in the digital age and users have found a

way to be connected and updated with the news

that interests them or simply through social

networks and other traditional media participate in

the entertainment they offer; also managing to

learn of raucous and presumably criminal facts

that on many occasions are presented without

evidence and lacking legal evaluations. This paper

aims to analyze the problem that arises for criminal

justice when mass media violate principles such as

the presumption of innocence and the limits of

freedom of the press are exceeded, concluding our

observations with some proposals to achieve

weighting and harmony that is necessary to

observe in the face of this widespread social

problem in avoidance of the affectations that occur

to the identity and personality of the subjects

involved in criminal acts.
