RESUMEN

Con la entrada en vigor del texto constitucional cubano del

año 2019 y las nuevas concepciones que d esde la doctrina

se establecen sobre los fines institucionales del matrimonio

se ha venido produciendo una actualización de la

legislación sustantiva cubana, vista desde varias

perspectivas, entr e las que se encuentran la familiar y la

penal. El Proyecto del Código de las Familias se muestra

coherente, desarrollando diversas instituciones jurídico-

familiares en correspondencia con las nuevas dinámicas de

nuestra realidad social, en las que se incluye el matrimonio;

entendiéndose que el mismo no solo crea relaciones

personales entre s us miembros, de las q ue se derivan

deberes de asistencia, solidaridad, entre otros, sino también

relaciones patrimoniales en la búsqueda de la realización de

un proyecto de vida en común. La legislación penal, por su

parte, provista de importantes camb ios, también brinda

una protección mucho más acabada de la institución

ABSTRACT

With the entry i nto force of the Cuban constitutional text

of the year 2019 and the new conceptions that from the

doctrine are established on the institutional purposes of

marriage, an update of th e Cuban substantive legislation

has been taking place, seen from various perspectives,

among which are family and criminal. The Family Code

Project is coherent, developing various legal-family

institutions in correspondence with the new dynamics of

our social reality , in which marriage is included;

understanding that it not only creates p ersonal

relationships among its members, from which duties of

assistance, solidarity, among others, are derived, but also

patrimonial relationships in the search for the realization

of a common life proj ect. Criminal legislation, for its part,

provided with importa nt changes, also provides a much

more complete protection of the institution.
