Abstract
is article deals with some aspects of the general theory of the administrative contract,
the types of contracts, the forms of administrative contracting. , Brief history of the arrival
of the administrative contract to countries in Latin America and doctrinal aspects about
its concept are provided, nally its location within the legislation is addressed, being able
to serve as a reference to reach the importance of administrative contracting., always
with comparative notes on the evolution in Europe and Latin America, as a result of the
research, a guide is provided for the study of the same, rescuing and updating the gure of
the administrative contract from the doctrine and in practice for Cuba, Bolivia and Latin
America.

     En concreto, la última Ley de Contratos del Sector
Público encontró su justificación, entre otras razones, en la exigencia de incorporar a nuestro ordenamiento
una nueva disposición comunitaria, como fue la Directiva 2004/18/CE del Parlamento Europeo y del
Consejo, de 31 de marzo de 2004, sobre coordinación de los procedimientos de adjudicación de los contratos
públicos de obras, de suministro y de servicios.
 

