Abstract

e succession due to death on a singular or private basis, despite having its own

substantivity and corporeality from classical Roman Law, faces various vicissitudes both

in the doctrinal and in the normative eld that sometimes make it blur compared to that

which is gives universal title. In this way, the legacy and the legatee, in their conceptual

formation, present outlines that are not completely clear and come to them many times from

the contrast with the notions of inheritance and heir, so that it ends up being a residual

concept.
