Abstract

e article refers to the caducity for non-use as a form of extinction of rights, and its

regulation in international agreements, especially its treatment under the laws of Cuba and

the United States of America. After briey reviewing the measures that have governed trade

relations between the two countries, the inuence of these in dierent scenarios is referred to.

e obligation of use, as an important category in industrial property and the analysis

of the justifying cause for non-use in the context of relations between Cuba and the United

States of America is explained with special reference to cases of Cuban trademarks registered

in the United States of America and that due to the measures established by the North

American government they cannot be commercialized, as well as the decision of technical

ocer in this matter in both countries before the application of the institution of caducity.
