RESUMEN

El contrato está urgido de un cambio en su papel actual.

No debe ser asumido como un simple documento formal

que validad la voluntad de los sujetos intervinientes, sino

que debe s er concebido co mo un instrumento jurídico

eficaz que posee un papel trascendental en el desempeño

eficiente de nuestro sistema empresarial. En el presente

trabajo se realiza un análisis de las principales

insuficiencias que perviven hoy en el proceso de

contratación económica en el ámbito de las relaciones

inter-empresariales en Cuba, haciéndose especial

referencia al papel que d ebe desempeñar el contrato como

instrumento esencial de la gestión económica que tributa

a un mejor desempeño de nuestras empresas, actores

económicos y en última instancia de la economía.

ABSTRACT

The co ntract is urg ed for a change in it s current ro le. It

should not be assumed as a simple formal d ocument that

validates the wi ll of the interveni ng parties, but sh ould

be c onceived as an e ffective legal instrument that h as a

transcende ntal r ole in the efficien t perfo rmance of our

business system. In the present work an a nalysis of the

main shortcomings that survive today in t he econom ic

contracting pr ocess in the fi eld of inter- business

relations in Cuba is m ade, ma king spe cial ref erence to

the role that the con tract should play as an essential

instrument of economic management that is taxed to a

better perfo rmance of our c ompanies, economic actors

and ultima tely of the economy
