Abstract

is article refers about the new Cuban Code of the families. is law must fully restore

the rights to inherit of the emigrated cuban citizens about theirs family who remains in

Cuba. is proposal is based in constitutional rules which to be in force since 2019, the

principles and norms of private international law and civil law that are applicable, as well

as the evolution of the characteristics and motivations of the cuban international migra-

tion. Also, it oers solution to the contradictions that subsist in legislation about this issue

and balance hereditary rights of emigrants and residents in Cuba based on citizenship as a

common element.
