The Real-Estate Mortgage: Guidelines for its Regulation in Cuba

RESUMEN

En la Constitución cubana de 2019 se reconoce el derecho

a tener una vivienda con condiciones adecuadas de

habitabilidad. En la actualidad, el ciudadano cubano no

tiene una forma segura de acceder al mercado inmobiliario.

Ello es una de las causas principales por la que varias

generaciones se ven obligadas a convivir en un mismo

inmueble, a veces incluso en condiciones de hacinamiento.

La hipoteca se presenta como una posibilidad real que busca

precisamente facilitar el acceso al mercado de la vivienda de

manera sencilla y legal. Dicha institución encuentra, en el

ordenamiento jurídico cubano, una regulación insuficiente

y por este motivo resulta necesario establecer las pautas

fundamentales que han de ser tenidas en cuenta para

reformar la legislación referida a la misma en el suelo

patrio.

ABSTRACT

On the Cuban Constitution of 2019 it´s recognized the

right to have a habitable house. Actually, the Cuban citizen

doesn´t have a secure and legal way to access to the real-

estate market and as a result many generations are forced

to live together in the same property, even if it doesn´t have

the conditions for it. The mortgage it´s presented as a real

possibility to make easier the mentioned access. However,

the regulation established by the Cuban law for that

institution is not the adequate. Acco rding to that, this

research pursues the objective of establish the fundamental

guidelines that has to be follow in order to remake the

regulation of the mortgage in Cuba
