Abstract

e patrimonial responsibility of the Public Administration is a legal guarantee of the

citizens in their relations with the State, seen as that adequate aspect so that individuals can

be compensated, for any injury they may suer, either in their property or in their rights,

except causes of force majeure, because of the operation of public services. e constitutional

regulations of each country must be closely related to the work of the administrative jurisdic-

tion, as occurs in Cuba; however, the Magna Carta homeland requires for its implementa-

tion of new complementary norms of development in administrative justice, some of which,

given their immediate validity, do not admit delays. is work aims to illustrate the neces-

sary theoretical elements regarding the patrimonial responsibility of the administration, as

well as the scope and content of Instruction 245 of the Governing Council of the Supreme

People’s Court, guarantor of the rights protected by the Constitution of the Republic of

Cuba from the 2019.To achieve this, the work starts from the theoretical postulate of the

constitutional bases with special reference to the content of Instruction 245, as the basis for

the foundation of constitutional supremacy applied to the Cuban administrative dispute.
