RESUMEN: El teletrabajo en el Ecuador ha sido reconocido desde 2005, pero no se ha evidenciado como un

mecanismo de uso obligatorio en medio de la pandemia mundial actual. Este tema motiva la presente

investigación, que fundamenta las causas y consecuencias que trajo consigo el teletrabajo en tiempos de

pandemia frente a la garantía de derechos consagrados en la Constitución, ante una crisis de salud y, por ende,

económica, que afecta al sector productivo del país. Frente a esta situación, aparecería la interrogante de si

pudiera acaso una Ley de apoyo hum anitario tener gran fuerza sobre nuestra Constitución. Mediante este

estudio se evidenciarán sus efectos jurídicos y sociales.

ABSTRACT: Teleworking in Ecuador has been recognized since 2005, but has not been evidenced as a

mechanism of mandatory use in the midst of the current global pandemic. This topic motivates the present

research, which bases the causes and consequences that brought with teleworking in times of pandemic against

the guarantee of rights enshrined in the Constitution, in the face of a health crisis and, therefore, economic that

affects the productive sector of the country. In front of this situation, it would appear the question of if it could

perhaps a Law of humanitarian support have great force on our constitution. This study will show its legal and

social effects.
