Summary

e legislator of the Cuban Civil Code places the regulation of the consignment

within the third section of Book III, dedicated to the creditor’s default. e gure of the

consignment, understood as an appropriate instrument that the legal system makes available

to the debtor to free himself from the obligation by depositing the thing due in the hands

of the authority empowered to do so, in the face of the verication of certain assumptions

previously established by law, is related, according to the systematic of the Code, to the

default of creditors, which is certainly one of the assumptions in which the latter can

proceed, but there are others, regulated exhaustively in the second paragraph of Article 254.

In this way, the gure studied moves away from the area in which, from a more technical

viewpoint, it should be developed: that of the extinction of obligations, as it is a subrogation

of compliance.
